# Terms and Conditions

These terms and conditions (“Terms”) govern your use of the Qurmy website at qurmy.com and the Qurmy platform at dashboard.qurmy.com (together, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

## 1. Definitions
“Account” means the user account you create to access the Service.
“Content” means any data, text, reports, or other materials generated by the Service or submitted by you through the Service.
“You” and “your” refer to the individual or organisation using the Service.
“We”, “us”, and “our” refer to Qurmy.
## 2. Eligibility
You must be at least 18 years of age to use the Service. By creating an Account, you confirm that you are 18 or older and that the information you provide is accurate.
## 3. Account Registration
To access the full Service, you must register for an Account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to notify us immediately at admin@qurmy.com if you become aware of any unauthorised use of your Account.
## 4. The Service
Qurmy provides AI search optimisation tools, including AI platform visibility tracking, content analysis, keyword research, website monitoring, and related functionality. The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be uninterrupted, error-free, or that the results obtained will be accurate or reliable.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
## 5. Subscriptions and Payment
Certain features of the Service require a paid subscription. Subscription plans, pricing, and included features are set out on our pricing page.
Payments are processed by Stripe. By subscribing, you agree to Stripe’s terms of service in addition to these Terms.
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period, and no refund will be issued for the remaining portion of that period.
We reserve the right to change our pricing at any time. Price changes will take effect at your next billing cycle, and we will provide reasonable notice of any increase.
## 6. Free Trials
We may offer free trial periods at our discretion. At the end of a free trial, your access to paid features will be restricted unless you subscribe to a paid plan. We will not charge you automatically at the end of a trial without your explicit consent.
## 7. Acceptable Use
You agree not to:
– Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
– Attempt to gain unauthorised access to the Service, other user accounts, or any systems or networks connected to the Service.
– Use automated scripts, bots, or crawlers to access the Service other than through our published API, unless expressly permitted.
– Interfere with or disrupt the Service or impose an unreasonable load on our infrastructure.
– Reverse engineer, decompile, or disassemble any part of the Service.
– Resell, sublicence, or redistribute access to the Service without our written consent.
– Submit or transmit any malicious code, viruses, or harmful data through the Service.
We reserve the right to suspend or terminate your Account if we reasonably believe you are in breach of this section.
## 8. Intellectual Property
All rights, title, and interest in the Service, including its software, design, branding, and documentation, are owned by Qurmy. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.
Data and reports generated by the Service using your website data belong to you. However, we retain the right to use aggregated, anonymised data for the purposes of improving the Service.
## 9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you agree to the terms of our Privacy Policy.
## 10. Third-Party Services
The Service may integrate with or provide links to third-party services (such as Stripe for payments, Cloudflare for security, and various AI platforms for visibility tracking). We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is subject to their respective terms and conditions.
## 11. Limitation of Liability
To the fullest extent permitted by law:
The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising from or related to these Terms or the Service shall not exceed the total amount you have paid to us in the twelve months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
